Mobile phone loophole for filming drivers 'to be closed'

It is illegal for drivers to call or text on hand-held phones but some have dodged punishment for taking photos., saying he was not using his phone"to communicate". Earlier this year Ramsey Barreto was found guilty of using his phone to film a crash in north London two years ago. However, the 51-year-old then successfully appealed the conviction.led two High Court judges to criticise the 16-year-old law on using mobile phones, which they said had failed to evolve with the rise of smartphones.

If the government are closing the loop hole why is it when police enforce the law dont use your mobile phone when driving and there seen doing setting a bad example does this mean hands is free is banned being pulled over cause u answer a call on steering far short of utter joke

Just today I followed a car (with company logos all over it!) whose driver was watching video on his phone in a holder attached to the windscreen. Unfortunately dashcam footage isn't clear enough to send to the police, but how irresponsibe! I have messaged the firm with stills.

How long before the ban the ludicrous 'touch screen infotainment systems in cars'...I see VolvoCarUK are advertising their new system is like using you phone in the car..

People should not be allowed to eat, drink or smoke in a car whilst driving either because those activities are just as distracting and dangerous as using a mobile phone

I don't think it's ever made really clear what's illegal and what's not. What can you legally do on your phone when it's docked? Press a button to accept a call? Turn the volume up so you can hear the satnav? Go through your contacts list?

perfectly fine to change the radio station on the radio or put the volume up and down

Yet, still no specific legislation against women applying make-up at the wheel.

If using sat nav is illegal how come Uber and phv use them whilst driving and their phones to get jobs?

I have camera's fitted front and back on my car. I have no reason to hold my phone whilst driving.

In Germany they fine ppl €120 if caught filming the scene of a crash. Take a look at one German police man shaming drivers

if you're holding anything other than the steering wheel or gear stick you are not in full control of the vehicle, there is no good reason to be holding a phone it should have been put out of the way before driving off. Eating or drinking while driving is a no no too.

It is discriminatory to prosecute you for holding a phone whilst driving as you might be just moving it whilst retrieving your water bottle

The catch all in the law is the term 'using ' this needs to be changed it is unfair holding your phone is considered using even though you may not be actively engaging receiving or transmitting calls or messages.

No real loophole, they could still be prosecuted for driving without due care and attention.
