When Revenue NSW takes unpaid fines and debts directly from an individual’s bank account as a last resort measure, it uses a process called a garnishee order to do so. But for several years, that automated process was done illegally, a report from the NSW Ombudsman revealed in a report on Tuesday.
New assessment processes have also now been put in place for garnishee orders, “so Revenue NSW staff review them before they are issued”. There are still more changes to be implemented to further ensure the protection of people who receive welfare payments, and to increase transparency surrounding the process. The NSW Solicitor General advised the NSW Ombudsman that the current version of the garnishee system, in place since 2022, is compliant.
