The IDA told 7NEWS.com.au the involuntary action could technically be classed as negligent driving, should an incident occur during the split second a motorist’s eyes are closed. That offence comes with a penalty of up to more than $5000 in Australia.
” If no one is hurt, but a dangerous swerve or a near-miss is caught by the relevant local authorities, on-the-spot penalties for first offenders can range in the territory of thousands of dollars. In New South Wales the offence can result in a $1,100 penalty; in Queensland it can result in a $5222 penalty, or six months in prison; in Victoria the penalty is $1771; in Western Australia the penalty is $1500.
