Harbor Police officers can cite people who refuse to comply with an ordinance that bans chairs, tables, tents or coolers on the promenade outside of the venue

Last May, teen pop sensation Olivia Rodrigo’s concert at the Rady Shell attracted a sold-out crowd of 8,500 paying customers. Another thousand-plus enterprising fans took in the show free of charge from the adjacent promenade and rocks overlooking San Diego Bay.

The ordinance, which amends existing port code, expressly bans the use or transport of large, sidewalk-blocking items — tents, chairs, coolers, portable stoves and storage wagons — on the promenade surrounding the Rady Shell venue on Embarcadero Marina Park South before and during events. The law also prohibits people from sitting on, climbing or otherwise hanging out on the rocks, called riprap, next to the promenade.

Opened on August 5, 2021, the Rady Shell at Jacobs Park is the 3.68-acre, $85 million waterfront venue built by and leased to the San Diego Symphony Orchestra Association. “Effective immediately, the fire access roadway must be maintained clear leading to the venue and the fire lanes must remain clear of spectators,” Tosca wrote in bold.
