My thought is that a plea deal for a lesser misdemeanor charge with suspended sentence is the most appropriate course of action here. This was a terrible and devastating accident but I believe that there was no malicious intent. There was also a civil settlement with the family.

Every year there are police officers shot and injured or killed during training exercises where an officer forgot to check to make sure his gun did not have any live rounds. No one is ever charged. It’s always ruled an accident.
